Cigarettes: United States Constitution and American Medical Association Essay
Should the production and sale of cigarettes be made illegal? Cigarettes have had a declining reputation ever since they were linked to various forms of cancer, and other debilitating conditions. Cigarettes were not seen as harmful until public awareness was raised about the issue. Now, there are many advocates for cigarettes and many against them, but does the government have the right to make decisions for the public? Sadly, in the democracy we live in today, there is not much democracy at all. If the government wanted cigarettes to be banned, cigarettes would be banned. The government follows its own agenda, regardless of the general public opinion. The government will always find a way to put a facade over the law and argue that no rights are being violated. According to the United States Constitution, under the authority of Article 1, Section 8, Clause 3, better known as the commerce clause, it reads, ââ¬Å"The congress shall have power â⬠¦ To regulate commerce with foreign nations, and among the several states, and with the Indian tribesâ⬠¦Ã¢â¬ . This states that the federal government has the authority to govern and regulate any commerce within the states. Article one also states, ââ¬Å"The congress shall have powerâ⬠¦ provide for the common defense and general welfare of the United Statesâ⬠¦Ã¢â¬ . So if the government decided to ban cigarettes they could use this Article to argue that they are looking out for the best of the public. It is under this law that the government is able to place bans on uncontrolled substances as well. So, if the Supreme Court holds power to ban an uncontrolled substance, like marijuana, but not cigarettes, it would be inconsistent. If it has the power to ban one, it has the power to ban both, under United States law. Both marijuana and cigarettes are considered parts of commerce amongst the states, so the federal government is able to place bans where they find applicable on both. How constitutional this is is infinitely arguable, and all bans placed on uncontrolled substances have been narrowly constitutional; however, it is the law. Cigarettes should not be banned because of the amount of money the government would lose from tobacco taxes. The government makes a considerable amount of money every year from cigarette taxes. Banning cigarettes would also create a black-market for the product and cause more trouble than good. Also, a ban on cigarettes would cause an increase in unemployment worldwide. Even with tens of thousands of people becoming unemployed, the potential for black-market cigarette retail, and a proportional loss in revenue for the government, critics argue cigarettes need to be banned. The problem with these critics is that their points of argument are thin at best, and fail to give substantial reasons for banning cigarettes. Most notably, the outcry of non-smokers claiming they have to pay extra taxes for old-aged smokers that have acquired costly health problems. An interesting proposal when there are so many studies that suggest the opposite. An article from The Journal of the American Medical Association suggests that in order to have full fairness, smokers should be paid between 22 cents and $1. 28 by non-smokers for each pack smoked. This would balance out the societal costs and savings from the smokers habits (Manning 261:1604). So, while statistics say smokers get cancers, heart disease and other conditions that require costly care at a younger age, the same statistics state that smokers die at an earlier age. Therefore, they are not collecting their full potential of pension and social security benefits in their older age. They also do not cause long-term geriatric or nursing home bills like non-smokers do. Another point to make is that when a non-smoker gets lung cancer it is blamed on genetics, but when a smoker gets lung cancer it is assumed it was from smoking. Who is to say that the smokerââ¬â¢s lung cancer was not genetics as well? It should also be noted that lung cancer is a quick, degenerative form of cancer that kills fast which again, supports the claim that smokers cost less for taxpayers. The American Medical Association was not the only organization making these claims. Later in 1993, The U. S.à Office of Technology Assessment stated, ââ¬Å"Reduction or elimination of smoking would improve health and extend longevity, but may not lead to savings in health care costs. In fact, significant reductions in smoking prevalence and the attendant increase in life expectancy could lead to future increases in total medical spending, in Medicare program outlays, and in the budgets of the social securityâ⬠¦Ã¢â¬ (OTA 60). If that is not enough to convince one, the Congressional Research Service conducted a similar study with similar conclusions in 1994 which was then published in 1997 in the reputable New England Journal of Medicine. The Congressional Research Service stated, ââ¬Å"Health care costs for smokers at a given age are as much as 40 percent higher than those for nonsmokers, but in a population in which no one smoked the costs would be 7 percent higher among men and 4 percent higher among women than the costs in the current mixed population of smokers and nonsmokers. If all smokers quit, health care costs would be lower at first, but after 15 years they would become higher than at present. In the long term, complete smoking cessation would produce a net increase in health care costsâ⬠(Barendregt et al 337). So smokers end up not costing as much as the public thinks in terms of healthcare, but what are some other reasons cigarettes should not be banned? How about the large chunk of money the government would lose from tobacco taxes? This is a very valid point seeing how revenue from tobacco taxes are used by the government as funding for hospitals, schools and other public amenities. Banning cigarettes would directly affect the amount of money the government has for these building costs. This would have a negative effect on the general public, particularly, their wallets. According to the United States treasury, in their fiscal year 2013 budget planning documents, the total federal revenue for tobacco is mentioned at over fifteen billion dollars for 2011. (U. S. Dept. of Treasury 16). With a lack of money coming from tobacco sales, the government would have to find another way to get funding for these projects and that would become evident with increases in property, income or alcohol taxes. Banning cigarettes would cause a general disturbance amongst smokers. To be able to smoke freely one day then for it to become illegal the next day would cause a lot of commotion. Harmless people in society would soon turn to illegal activities, such as smoking a cigarette, and be prosecuted for it. People are addicted to cigarettes, so a ban would not stand in the way of a lot of smokers trying to get what they want. Not only would there be a lot of irritable citizens, there would be a lot of productive and useful citizens being booked for petty crimes like possessing cigarettes. A black-market would ensue the ban and cause more trouble for the government than good. Foreign countries notorious for black-market activity would hop on the bandwagon as soon as they got word of the ban and start selling cigarettes illegally to under the table distributors in the United States. In the end, the government would end up spending more money monitoring the illegal sales of cigarettes instead of spending it on more beneficial things to society like finding and prosecuting murderers, kingpins, and organized crime. Overall, it would not be worth it. Loss of jobs needs to be accounted for as well. Not just the cigarette industry but also all the workers that contribute to the process of making a pack and selling it to distributors. There are people employed to make the cardboard-like cigarette boxes, people employed to make the paper that wraps around the cigarettes, people employed that make the designs on the packs, people employed to make the cellophane that wraps the outside of the pack. Also the truck drivers that deliver the cigarettes, and the engineers that keep the machines running in the cigarette factories, and the people who harvest tobacco, and all of the executive positions within all of these companies. The North Carolina Department of Agriculture and Consumer Services stated 662,400 people are employed with tobacco related jobs in the United States alone and worldwide, in the tens of millions (NCDA&CS 2). What people against cigarettes do not realize is how far the ban would reach and affect the livelihoods of a massive amount of people across the globe. Banning cigarettes would cause more problems and be another thing to worry about for the government and the citizens. The government would lose money from its tobacco tax, a black-market for cigarettes would be made, forcing the government to take action, and most importantly tens of millions of employed people would be without a job. It would not make sense to stir up commotion because a few people are concerned about health risks or smokers causing extra taxation for healthcare. As stated before, smokers cost less than non-smokers and a complete cessation of smoking would cause an increase in health care taxes in the long run. For the critics saying how bad smoking is for someoneââ¬â¢s health, they have no authority to tell people how they should live their lives. People have the freedom to choose what they do to their bodies. The general public is able to make their own decisions and the government should not be able to make decisions for the public in regards to what they put in to their bodies. Even though constitutional law saws congress has the power to make choices for the welfare of its citizens, it still should not be allowed. What personal freedoms do we have if the government starts telling us we cannot smoke cigarettes? Soon they will be telling us to stop eating so much and sleeping so little. The government will say it is for the better of the people and that they are trying to keep the public healthy, but since when does the government genuinely care about the public? The government runs its own agenda regardless of the public. It is well known that the government is not planning on banning cigarettes anytime soon. Whichever party is responsible for that decision will lose a very large amount of its support network and neither political party is willing to take that risk. Plus why take that risk when there is a chance for the government to make more money by increasing cigarette taxes? The government just wants money. The government is addicted to cigarette taxes as much as smokers are to cigarettes.

The world, as you know it, has changed as a result of globalization. Local or nationalistic perspectives is transforming to broader outlook of an interconnected and interdependent world with free transfer of capital, goods, and services across national frontiers. To be more specific, due to the development of transportation and telecommunication that the globalization plays an important role of life is irreversible. It presents in plenty of aspects of life, namely trade, culture, tourism, sports, medical treatment,â⬠¦ People now find it much easier struggling to deal with things, ranging from daily demands to huge decisions not only domestically but internationally as well thanks to the advanced technology brought about by efforts of nations. For example, contacting with friends, even visually in distance is just like a piece of cake with a mobile phone or laptop. In terms of transports, it now allows you to make it to the opposite side of the Earth within few days. Concerning health care, receiving the same quality treatment but lower cost is not unthinkable, it is a reality to developed citizens who dare travel to developing areas. Our group chose this name because it was the first potential name crossing our minds after the question was raised. In order to adapt to the world, it is essential that you first of all become a globalized student. Approaching the globalization requires general and detailed knowledge of specific fields. For instance; if you want to send an email, then you learn how to write an email; if you want to call a partner, then you must have the numbers; if you want to use airplane service, then you must know how to make it to the waiting lounge. Simply speaking, you want to fly, you must have wings first. We not only hope for the best but also prepare for the worst. How does this name relates to International Business? Plainly in evidence that chapter 1 of the subject tells the importance of the name. It represents not only as the foundation of the study but as the future of how students establish their points of views towards economic, financial, trade, and communications integration. Students planning to work in multinational enterprises or run their own business have to master and learn how to be a globalized students in the range of university,à specifically in class of home before any further matters can be discussed. Frankly speaking, learn how to swim well at pool first or else you are going to be drown in deep ocean. 1.A decade ago the idea that medical procedures might move offshore was unthinkable. Today it is a reality. What trends have facilitated this process? The conventional concept of receiving medical treatment abroad some decades ago was something rare or even unthinkable. However, in recent years, this whole traditional idea has completely changed. The trend has shifted dramatically from the point which the citizens of many countries traveled to the United States and to the developed countries of Europe to seek the expertise and advanced technology available in leading medical centers, to the situation nowadays wherein citizens of highly developed countries choose to bypass care offered in their own communities and travel to less developed areas of the world to receive a wide variety of medical services. This significant change is brought about by the two main factors: the relentless development of technology and the cost advantage The relentless development of technology The 21th century has witnessed many outstanding breakthroughs in technology, especially in telecommunication, transportation and medical field. The development in telecommunication, in which the Internet is the biggest example, allows medical treatment abroad to be carried out in a faster and more convenient way. For example, with Internet, radiologists in the US can beam images to India where they could be interpreted by the Indian counterparts. Moreover, since India is on the opposite side of the globe, the interpretation of the images could be done while it was nighttime in the United States and be ready for the attending physician the following morning. Also, the advance of transportation makes possible the travel from one country to another in the shortest time and the least expensive way. Furthermore, the improvement in the medical field also provides developing countries to not only develop their domestic health care services but also expose to higher technological equipment. This contributes to the expansion of a global health care supply chain. As a result for people who seek overseas medical treatment, they can get access to a more various marketplace that provide the services. Some typical examples are India, Thailand, â⬠¦ The cost advantage Although technological advance plays an important role in bringing about the overseas medical treatment, still the strongest driving force that facilitated the globalization of health care is the cost. In developed countries such as the US, the expenses are far greater than that of those provided in less developed or developing countries. This alone has persuaded a large amount of patients to find treatment elsewhere. In fact, it also gave birth to a new trend which is called ââ¬Å"medical tourismâ⬠, wherein patients would visit a foreign land to receive complex, sophisticated and often serious medical or surgical care. Following the treatment the ââ¬Å"touristâ⬠can experience personal medical attention in a luxurious setting with first class accommodation and subsequently has the chance to enjoy vacation for a short time before going back home. Howard Staab is an ideal example for this cost advantage. Mr. Staab underwent a leaking heart valve surgery in New Delhi and toured the Taj Mahah afterward with the total price of $10.000, which is a lot cheaper than the $60.000 cost alone for the operation cost in the US, without the visit to the Taj Mahal. Others Besides the two main drivers mentioned above, there are some other factors involving in the decision ââ¬â making of the consumers in this overseas health care services. Some people who had undergone medical care in a foreign country said that they did it to circumvent the delays associated with long waiting list. This so called ââ¬Å"long waiting listâ⬠phenomenon recently has made as 40 veterans died while awaiting care at the Phoenix VA hospital. Also, the involvement of insurance companies by offering enrollees the option of getting treatment abroad for expensive surgeries could provide this trend a big boost. 2.Is the globalization of health care good or bad for patients? Globalization is becoming more and more a part of our society. The health care industry is also affected by globalization. Physicians are traveling to other countries to perform volunteer work and patients are traveling to other countries to receive medical care. This has both beneficial and harmful influence on the patientsââ¬â¢ health. Positive impacts Adequate care for patients in developing countries Globalization has brought access to medication from manufacturers to less developed countries where patients can either not afford it, or would not have access to it. Patients in these countries also have a lack of diagnostic capabilities and poor transport options. The Glievec International Patient Assistance Program (GIPAP) is an international program that works with drug manufacturers to distribute medication to patients. Under the program, the manufacturer provides drugs at no cost directly to eligible patients. This program helps over 18,000 patients worldwide each year. Furthermore, physicians, students, and other professionals volunteer to travel to other countries and provide medical treatment to those who live in countries that do not have adequate health care. For instance, sub-Saharan Africa has roughly twenty-five percent of the global disease burden, yet only three percent of the global health care workforce. Since globalization of the health industry is currently in process, physicians from around the world are participating in ââ¬Å"medical missionsâ⬠to developing countries to administer medical care. The circulation of patients The outsourcing of medical procedures to nations where medical professionals are paid lower could clearly benefits consumers. The movement of patients is a more recent phenomenon. Though still marginal, so called ââ¬Ëmedical tourismââ¬â¢ is becoming more important. Treatments offered in western Europeans countries attract infertile couples from United States because they cost half or one third of those provided in North America. Elective surgery offered in highly sophisticated Indian hospitals tends to cost only 10ââ¬â20% of identical treatment in western countries. There is also a shift from personal initiatives to national incentives. Tunisia, for example, organized a conference at the beginning of December 2004 to attract health care purchasers from abroad. Purchasers, even those belonging to public systems can potentially be interested, when a reduction of costs by as much as 50ââ¬â80% can be realized. Negative impacts Developing international standards in medical education and health care delivery can help improving quality in health care all over the world. Nevertheless, two problems remain. Potential of such developments to improve the quality in health care within the world International standards cannot be created that will fit the cultural, social, and economical contexts of very different countries. It is often assumed that, simply demonstrating compliance with quality processes, will lead to a result (of the treatment) that will be the same, whatever the country or the professionals involved. But it cannot be definitely sure that applying North American (or European, or for that matter African or Asian) procedures and quality rules in other countries will lead to adequate quality. Issues of access to health care and ethical dimension Countries which continue to accept patients from other lands for expensive services run the risk of either pricing out poorer citizens, or creating a second tier of medical care in those countries. Further, ethically speaking, it is not acceptable to exclude the local population from the benefits of care that is provided in their country for rich strangers, even if this organization allows less rich countries to develop employment in the health care sector. In addition, medical tourism may shift services fromà preventive public health measures, to less effective and more expensive private clinics. The treatment standards in countries such as India may not be up to the standards found in the United States, and that the process takes some control out of the hands of the consumers. Finally, there are some of the potential dangers of volunteerism. When students or physicians with little education or knowledge of the culture they are in or volunteer, patients of those countries run the risk of making their symptoms worse. In conclusion, with healthcare globalization, patients in less developed countries can receive medication and care that they would not receive otherwise, doctors and physicians can volunteer and travel to other countries to provide care and treatment. Patients also have the ability to travel to other countries to receive care that would normally be very expensive in their own country. However, globalization runs the risk of patients in other countries not receiving quality care due to volunteers lacking in education, as well as ethical dilemmas. 3.Is the globalization of health care good or bad for American Economy? In general, there are many concerning about globalization of health care that have been proposed by Americans economists. In fact, many aspects has come up to this problems. Here are the examples. Impatient Americans seeking medical care are increasingly making trips far from home, often at their own expenseââ¬ânot just short hops to Caracas for a nip and tuck or dashes across the frontier for cheap Mexican pills. As Mr. Steeleââ¬â¢s testimonial suggests, they are now travelling across the world for knee and heart surgery, hysterectomies and shoulder angioplasties. One motive is to save money. Americaââ¬â¢s health inflation has consistently outpaced economic growth, making it the most expensive health market in the world. The average price at good facilities abroad for a range of common medical procedures is, by Deloitteââ¬â¢s reckoning, barely 15% of the price a patient would have to pay in the United States (see table). But costs have long been much higher in America than in poor countries, so this alone does not explain the new exodus. Two other factors are now at work. One is that the quality at the best hospitals in Asia and Latin America is now at leastà as good as it is at many hospitals in rich countries. The second, more worrying, factor is that Americaââ¬â¢s already imperfect insurance safety net is fraying. Over 45m Americans are uninsured, and many millions more are severely underinsured. Such people may find it cheaper to fly abroad and pay for an operation out of their own pockets than to find the money for deductibles or ââ¬Å"co-paymentsâ⬠charged for the same procedure at home. Arnold Milstein of Mercer, a consultancy, calls them Americaââ¬â¢s ââ¬Å"medical refugeesâ⬠. Big business may soon join this wave. Epstein, Becker & Green, an American law firm, says that in the past year big employers have become interested in promoting medical travel among the employees they insure. Many are struggling to cope with soaring health costs and some, they report, are willing to take radical steps to save money. Behind the mask How will that affect the health systems in rich and developing countries? Listen to critics of medical travel, and you might think that all of this is a tragedy. It has come about, they argue, because of the terrible state of Americaââ¬â¢s health care, and its consequences for developing nations will be dire. The flow of foreigners will encourage capital and trained staff to flee state-run health-care systems in poor countries in favor of better-paying jobs catering to foreigners and local fat cats. It is surely right that medical tourism is partly the result of the failings in Americaââ¬â¢s health system. Moreover, recent research by the World Bank does indeed suggest that ââ¬Å"internal brain drainâ⬠is a worry in some countries, especially those with few doctors and nurses. However, in many huge net exporters of doctors and nurses, such as India and the Philippines, an internal brain drain is hardly much of a worry, because there are plenty of medics to go around. And shortages, in countries where they exist, can be alleviated by reforms changing the way nursing education is funded, for instance, that would help to improve their ailing state-run health systems. 4.Who might benefit from the globalization of health care? Who might lose? Throughout history people have always shared information, traded commodities and exchanged some forms of currency across various borders, which proves globalization an enormous interest of human being. Consequently, health careà industry is no longer a norm of services provided where the patients located. The links between globalization and health are complex and globalization is a multifaceted phenomenon that can affect health in myriad ways. Its consequences can be either direct, at the level of whole populations, individuals and healthcare delivery systems, or indirect, through the economy and other factors, such as education, sanitation and water supply. For the health community, globalization offers opportunities but also poses significant challenges to many sectors. The customers (the patients) Benefits: â⬠¢Quick response to deceases with lower costs: Due to the imbalance between supply and demand of health care in the United States, the patients have been undergoing overloaded treatment with high costs. The shortage of radiologists in America cause patientsââ¬â¢ diagnostic medical images (including X-rays, CT scans, MRI scans and ultrasounds) to be read and interpreted for longer hours. However this can be resolved more quickly by beaming the images over the Internet for Indian radiologists. Another situation of Howard Staab, who completed his leaking heart valve cure in New Delhi, India for $10,000 instead of paying $60,000 for American hospitals, proves financial benefits for patients. â⬠¢Chances for traveling: Medical tourism is a second mechanism through which the patients can benefit through trade liberalisation in healthcare. Taking advantage of abroad trips for medical services, patient could also travel for convalescence in famous tourist attractive destinations, which costs totally lower than treatment in the United States. Losses: â⬠¢Spread of infectious deceases: The flip side of the above benefit is that due to the rapid mobility of people across borders for health care services, the spread of infectious diseases is a threat to everyone, particularly the poor. It is entirely possible that a person in the early stages of an infectious disease could travel halfway around the world in 12ââ¬â15 hours, which functions as a vector for that disease to spread into non-immune populations. The recent epidemic of Severe Acute Respiratory Syndrome (SARS) is the best contemporary example of serious damages to the community due toà globalization of health care. â⬠¢Involved risks due to absence of international insurance policy: Since the U.S Government-sponsored medical insurance program, Medicare, would not pay for services done outside of the country, patients without international medical insurance could be harmed. The developing countries Benefits: â⬠¢Improve health care status & create employment opportunities for health care and tourism: Several decades ago very few hospitals in developing countries could claim to offer the highest quality of health care. Due to globalization of health care, hospitals around the world are striking to meet the stringent requirements, improving health systems standards to attract foreigners, which also benefits local patients. Besides, it would also be useful to encourage developing countries to tax medical tourism and use the proceeds to support their domestic healthcare system. Consequently, health care globalization is creating more works for local health care and tourism industry. According to the management consultancy McKinsey & Co., medical tourism was a$2.3-billion industry in India in 2012. Losses: â⬠¢Internal brain drain of medical professionals: Another dilemma that seriously affects people in developing countries, as well as poorer communities in the industrialized nations, is a lack of health professionals. If there are going to have a global world, then people who have these needed skills should be paid appropriately, which induces them to work for well-paid medical industry. The developed countries (the United States) Benefits: â⬠¢Potential gains for the economy: The U.S government could attain profits on providing education of modern technological medical system for developing countries. Besides, insurance companies could offer international healthcare vouchers to be secured while using foreign facilities and sharing their savings. Losses: â⬠¢A small fraction of work and treatment moving offshore: Even though the U.Sà regulations require that a radiologist be licensed in the state and will not pay for international medical treatment through Medicare, there would be a small fraction of patients travel abroad for health care due to their overweighed benefits. Polycarbonate bottles used as babies can have long term consequences in children. To prevent exposure to this health risk, Nuby has created baby bottles, cups and toys that are Bisphenol-A free. These are relatively more expensive than the regular polycarbonate ones, but considering the safety of children from the fatal risks, they are definitely worth it. Main Findings Nuby has approached Parentsââ¬â¢ Magazine which advertises its products, to launch its new line of BPA-free products. These are feeding bottles, sippers, cups and bowls for infants and toddlers which are not made of polycarbonate material and which are free from the toxic substance, Bisphenol-A. Nuby has created such ââ¬Å"products to eliminate any risk or doubt and offer parents the safest optionâ⬠(Nuby website, 2013). Parents Magazine invited HealthyChildren.org to co-organize the event launch since this organization has the ââ¬Å"only parenting website supported by 60,000 pediatricians comm itted to the attainment of optimal physical, mental, and social health and well-being for all infants, children, adolescents, and young adultsâ⬠(HealthyChildren.org.). Having doctors speak about Bisphenol A is a responsible act in promoting health issues concerning parents and their children. Both organizations, Parentsââ¬â¢ Magazine and HealthyChildren.org will add credibility to the endorsement of the new line of Nuby products. Both organizations are opinion leaders and opinion formers that can greatly influence the preferences of consumers. Event marketing is presented as a way to build brand equity (Keller, 2009). Band equity is the ââ¬Å"added valueâ⬠which a given brand provides a certain product (Farquhar, 1989). In the case of Nuby products, being BPA-free is the brand equity. And the result of the research is that there are some correlation between the corporate governance and performance of company. Results of their finding is the earnings in Thailand and Indonesia was reduced during the Asian financial crisis and increased in book of value. In Korea , neither earnings nor book of value was impacted by the crisis. And the last one which is in Malaysia both book of value and earnings was decreased during the Asian financial crisi s. Bernard S. Black , Woochan Kim , Hasung Jang , and Kyung-Suh Park (2009) conduct a research in KCGI (Korea Corporate Governance Index). They try to find the relation between level of corporate governance and the effects the firm market value. And the findings of their research that overall firms that are better governed got a some competitive advantage than other company. From the research , overall firms who got higher KCGI will get higher dividends , got a lower capital expenditures ( because of Korea firms that are overinvest) but the investment is more sensitive to profitability , lagged board structure predicts higher profit , the related party transactions will reduce adverse for firm value. From the research he suggested that companies in Indonesia need to strenghten shareholder access to the information of the company , in treating the shareholders must be equally , and company must fully adopt the International Financial Accounting Standards (IFRS) and also International Standards of Auditing. Meidyah Indreswari (2006) identified Indonesia corporate governance status which was turn bad because of the tragedy of economic crisis in 1997. From the research the writters found out there are several factors that make corporate governance fail in that year. Firstly, using agency theory to explain the relation between the agent and the principal was more problematic in ISOEs than the private enterprise. Sanjeev Bhojraj and Partha Sengupta (2001) they conducted research about the effect of corporate governance to the bond ratings and yield. They found out that corporate governance mechanisms will reduce conflicts of interest between the directors and the providers by monitoring to their actions. And they were also found out that company which have a greater institutional ownership and got influence by the external control of the board will have a lower bond yields and high ratings for the new bond issues. From the research they are suggested that company that are facing stronger external monitoring from the governance mechanisms are rewarded with low yields and high bond ratings. According to his research Indonesia had so much law that must be follow , the law will make some difficulties for the company to perform. Siti Nuryanah (2009) said there are still a problem in Indonesia corporate governance specially in audit committee. The problems in audit committee in Indonesia is that they holding a double positions in other companies, which it make the audit committee is not efficient in doing the works. And also , there are some company that does not have an audit committee. By not having an audit committee will become a problem for the board of committe in taking a decision. The research found out that 30 % from the JSX (Jakarta Stock Exchange) public listed companies does not have independent commisioners. Although that kind of problem occure , from her results it was found out that most of the companies in Indonesia have complied with the regulation of corporate governance. Chapter 3 Methodology 3.1 Data The data of this project was taken from annual report in Indonesia stock exchange, IICD (Indonesia Institute for Corporate Directorship) reports which is the latest report, and 100 questioners which is given to the working people in Indonesia. The questioner was translating into Indonesia Language. 3.2 Methodology In this project there are two-research question that can lead to the answer of this research project. Each of the research questions will be tested in different type of statistical analysis test. The two-research questions of this project are: First: Is it true that adopting good corporate governance will attract more investors? Second: Using some factors in corporate governance reports, does most company in Indonesia have report their corporate governance data transparently? By using these research questions, several questions in the questionnaire had been made to gather answers from the respondents which then it will be linked back to answer the research questions. Inside the questioner there are divided into two section. The first section of the questioner is basic question about the corporate governance and the employee posisition in a company which they are working. The second section of the questioner is the important answer for this project which is contain all information that will be used to analyze. As for the following questions in the questionnaires, respondents will be asked about questions which are mostly related to the research questions 3.2.1 Research Question 1 Is it true that adopting good corporate governance will increse the company performance ? Hypothesis: H1: good corporate governance will give a significant effect to the company performance H0: good corporate governance will not give a significant effect to the company perfirmance From the research that was conducted by Lawrence D. Brown and Marcus L. Caylor (2004) said that there were some advantages in adopting a good corporate governance. He was using a sample of 2,327 companies and based on 51 corporate governance provisions that are provided by Institutional Investor Services (ISS). And found out that company that are better governed are relatively got a better income or more profitable and most of the shareholders got more dividend from the company. Murhadi (2009) explored some information period 2005-2007 in Indonesia Stock Exchange specializes in manufacture companies to test the performance of the corporate governance in Indonesia. One of the result from his research was, he found out a lot of companies in Indonesia still not develop transparency in reporting data of the company. A lot of companies want to avoid tax by creating an incorrect data, which is making the revenue of the company looks smaller. Another researcher were Zheng Fan , Liyan Wang , Jidong Zhang (2008) they are argued that the company disclosure data and corporate governance of the company will not effects the earning quality of the company I would like to test whether most of the companies in Indonesia have disclosed their coporate governance data transparently. The data show in two different categories which are State Owned Enterprises sector and Banking sector. However, there are some improvement of corporate covernance practices in both of the group. There were around four percent of increasement for those top quartile and bottom quartile respectively. It is still challenging tasks facing Indonesian corporations, regulatory bodies, and other governance-related institutions how to enhance the commitment of these bottom quartile companies to good corporate governance practices as well as those companies with corporate governace performance between the top and the bottom quartile. This does not mean that attention to those top quartile firms is not necessary. In the meantime, empiric al evidence shows that corporate governance is significantly correlated to companyà ¢Ã¢â ¬Ã¢â ¢s economic performance, although the correlation is weak. Inside the survey they are consisting 5 principles of OECD which are : Rights of Shareholders , Equitable Treatment of Shareholders , Role of Stakeholders , Disclosure and Transparency , and Responsibilities of the board. From the survey the IICD institute analyze the status of corporate governance in Indonesia in the year 2008. The results of research shows there are deflation in rights of shareholders in the year 2008 which is 50.37 % and from the previous study it shows that 51.23 %. But others factors for corporate governance in Indonesia had been increase in 2008, such as equitable treatment of shareholders in the year 2008 was 86.35% which is shows an advancement comparing to the previous study only 83.02 %. The role of stakeholders percentage also rise up in the year 2008 which is 63.64 % comparing to the previous study which in only 58.76%. Other factors that have been changing which is disclosure and transparency of the company, in the year 2008 it reach 70.81 % and the previous study only reach 52.36 %. The last factors that upsurged was responsibilities of the board, in the year 2008 in achieve 59.02 % and the previous study only 52.36 %. The overall mean score of the year 2008 was 64.96 % and the previous study was 61.26 %. The data shows that by using the OECD principles , the situation of corporate governance in Indonesia is getting better. They found out that it is depends on the corporate governance mechanisms and accounting system in effecting the book value of equity and it is also determining the relation between the accounting information and stock prices during the economy-wide financial crisis. Results of their finding is the earnings in Thailand and Indonesia was reduced during the Asian financial crisis and increased in book of value. In Korea , neither earnings nor book of value was impacted by the crisis. And the last one which is in Malaysia both book of value and earnings was decreased during the Asian financial crisi s. Bernard S. Black , Woochan Kim , Hasung Jang , and Kyung-Suh Park (2009) conduct a research in KCGI (Korea Corporate Governance Index). They try to find the relation between level of corporate governance and the effects the firm market value. And the findings of their research that overall firms that are better governed got a some competitive advantage than other company. From the research , overall firms who got higher KCGI will get higher dividends , got a lower capital expenditures ( because of Korea firms that are overinvest) but the investment is more sensitive to profitability , lagged board structure predicts higher profit , the related party transactions will reduce adverse for firm value. By developing a good corporate governance he found out that it will helps increasing the share prices and it will be easier to obtain capital. And from his research information which is from the Worldà ¢Ã¢â ¬Ã¢â ¢s bank ROSC report about rights of shareholders , equitable treatment of shareholders , role of stakeholders in corporate governance , disclosure and transparancy , and responsibility of the boards from the scale one to five , Indonesia overall score is 2.83% which conclude from his research that corporate governance in Indonesia is need to be develop. From the research he suggested that companies in Indonesia need to strenghten shareholder access to the information of the company , in treating the shareholders must be equally , and company must fully adopt the International Financial Accounting Standards (IFRS) and also International Standards of Auditing. Meidyah Indreswari (2006) identified Indonesia corporate governance status which was turn bad because of the tragedy of economic crisis in 1997. From the research the writters found out there are several factors that make corporate governance fail in that year. Firstly, using agency theory to explain the relation between the agent and the principal was more problematic in ISOEs than the private enterprise. Secondly, the rules of board director and management is really important for the company. The questioner was translating into Indonesia Language. 3.2 Methodology In this project there are two-research question that can lead to the answer of this research project. Each of the research questions will be tested in different type of statistical analysis test. The two-research questions of this project are: First: Is it true that adopting good corporate governance will attract more investors? Second: Using some factors in corporate governance reports, does most company in Indonesia have report their corporate governance data transparently? By using these research questions, several questions in the questionnaire had been made to gather answers from the respondents which then it will be linked back to answer the research questions. Inside the questioner there are divided into two section. The first section of the questioner is basic question about the corporate governance and the employee posisition in a company which they are working. The second section of the questioner is the important answer for this project which is contain all information that will be used to analyze. As for the following questions in the questionnaires, respondents will be asked about questions which are mostly related to the research questions 3.2.1 Research Question 1 Is it true that adopting good corporate governance will increse the company performance ? Hypothesis: H1: good corporate governance will give a significant effect to the company performance H0: good corporate governance will not give a significant effect to the company perfirmance From the research that was conducted by Lawrence D. Brown and Marcus L. Caylor (2004) said that there were some advantages in adopting a good corporate governance. He was using a sample of 2,327 companies and based on 51 corporate governance provisions that are provided by Institutional Investor Services (ISS). And found out that company that are better governed are relatively got a better income or more profitable and most of the shareholders got more dividend from the company. Another people that argued about corporate governance mechanisms were Sanjev Bhojraj and Partha Sengupta they found out corporate governance mechanism can reduce a conflicts of interest between the directors. And also a company should monitoring inside the company so the goodness performance of the company can be maintain. From this type of question, from the statement above I would like to test whether companies that have a good corporate governance will have a lot of investors in it and also is it will attract more investors to the company. Using the survey question, it will guide to the answer of this question which are : How effective is the corporate governance report being used in your company? In your opinion, does good corporate governance will attract more investor? H0: à ? = 0 (There is no correlation between corporate governance and number of investors) H1: à ? à ¢Ã¢â¬ °Ã 0 (There is a correlation between corporate governance and number of investors) Sample correlation coefficient, commonly denotedÃâà r, is calculated as following: Where X and Y are the sample means. T-test for correlation formula: 3.2.2 Research Question 2 Does most company in Indonesia have reported their corporate governance activity data transparently and disclosed it to the public on time ? Hypothesis: H1: All of the companies in Indonesia have disclosed their corporate governance activity transparently and on time H0: Not all of the companies in Indonesia have not disclose their corporate governance activity transparently and on time Werner R. Murhadi (2009) explored some information period 2005-2007 in Indonesia Stock Exchange specializes in manufacture companies to test the performance of the corporate governance in Indonesia. One of the result from his research was, he found out a lot of companies in Indonesia still not develop transparency in reporting data of the company. A lot of companies want to avoid tax by creating an incorrect data, which is making the revenue of the company looks smaller. Another researcher were Zheng Fan , Liyan Wang , Jidong Zhang (2008) they are argued that the company disclosure data and corporate governance of the company will not effects the earning quality of the company I would like to test whether most of the companies in Indonesia have disclosed their coporate governance data transparently. Because a good corporate governance will show a transparency data, all the performance of the companies which is bad or good must be inform to the public. One à ¢Ã¢â ¬Ã¢â¬Å"Way Anova (Parametric Test) From using this type of test , data that used to this test will be from question number 7, question number 8, question number 9 and question number 10 , the question from the survey have been desing will be in a way that respondents are asked to rate . This test is used to test the equality of 3 or more means by using the variances. H0: Ãâà µ1= Ãâà µ2= Ãâà µ3= Ãâà µ4 ( Most companies in Indonesia have disclosed their corporate governance activity transparently and on time) H1: Ãâà µ1à ¢Ã¢â¬ °Ã Ãâà µ2à ¢Ã¢â¬ °Ã Ãâà µ3à ¢Ã¢â¬ °Ã Ãâà µ4 ( Not all of the companies in Indonesia have not disclose their corporate governance activity transparently and on time) The formulas for the various sums of squares are as follows: SSE = SST à ¢Ã¢â ¬Ã¢â¬Å" SSA X = sample value ith item in the jth sample n = total sample size Xj = sample value of jth sample nj = size of the jth sample We will get the respective variances if we divide the sum of squares of SSA and SSE which are as follows: F-test formula: P-value: Degrees of freedom = k-1 Degrees of freedom = n-k These two values will be used to find the critical values for the F statistic and helps us to know whether the p-value is less than or more than the significance level. Conclusion: A null hypothesis will be rejected when the significant value from the test is lower than 5 percent 3.2.3 Limitations In this project there are some limitations in it. This project only representing a small objectives of coporate governance practices in Indonesia. Moreover, the data collected from this study are limited which is only from the Indonesia Institute of Corporate directorship and 100 questioners that had been given the working people in Indonesia. IICD ( Indonesia Institute of Corporate Directorship) have made a report about the corporate governance status in Indonesia. Since the corporate governance report 2009 have not been come out yet, I am using the data from the year 2008 which is issued in 2009 by the IICD institute. The data show in two different categories which are State Owned Enterprises sector and Banking sector. There were difference in Corporate governance performance between the SOEs variable and Banking variable. The SOEs performance was 75.20 %, while Banking was only 56.50 %. However, there are some improvement of corporate covernance practices in both of the group. There were around four percent of increasement for those top quartile and bottom quartile respectively. It is still challenging tasks facing Indonesian corporations, regulatory bodies, and other governance-related institutions how to enhance the commitment of these bottom quartile companies to good corporate governance practices as well as those companies with corporate governace performance between the top and the bottom quartile. This does not mean that attention to those top quartile firms is not necessary. In the meantime, empiric al evidence shows that corporate governance is significantly correlated to companyà ¢Ã¢â ¬Ã¢â ¢s economic performance, although the correlation is weak. Inside the survey they are consisting 5 principles of OECD which are : Rights of Shareholders , Equitable Treatment of Shareholders , Role of Stakeholders , Disclosure and Transparency , and Responsibilities of the board. From the survey the IICD institute analyze the status of corporate governance in Indonesia in the year 2008. The results of research shows there are deflation in rights of shareholders in the year 2008 which is 50.37 % and from the previous study it shows that 51.23 %. But others factors for corporate governance in Indonesia had been increase in 2008, such as equitable treatment of shareholders in the year 2008 was 86.35% which is shows an advancement comparing to the previous study only 83.02 %. The role of stakeholders percentage also rise up in the year 2008 which is 63.64 % comparing to the previous study which in only 58.76%. Other factors that have been changing which is disclosure and transparency of the company, in the year 2008 it reach 70.81 % and the previous study only reach 52.36 %. The last factors that upsurged was responsibilities of the board, in the year 2008 in achieve 59.02 % and the previous study only 52.36 %. The overall mean score of the year 2008 was 64.96 % and the previous study was 61.26 %. The data shows that by using the OECD principles , the situation of corporate governance in Indonesia is getting better. Chapter 5 Conclusion and Recommendatio
